Petition to Reopen a California Workers’ Comp Award: The Five-Year Record

A workers’ compensation award does not make every later change irrelevant. California provides a route to reopen for new and further disability, but the five-year limit runs from the date of injury and the filing must identify a genuine post-award basis rather than simply repeat the original dispute.

Calendar five years from the injury date

DWC’s Information and Assistance guide states that a petition to reopen for worsened disability must be filed within five years from the date of injury. Do not calculate from the award, settlement, last treatment, or the date the condition was finally diagnosed. Preserve proof that the petition reached the WCAB before the statutory period expired.

Identify what is new or further

Compare the medical and vocational record at the time of the award with the later evidence. A useful physician report explains the changed diagnosis, impairment, work restrictions, need for care, or causal relationship. A bare statement that symptoms are worse leaves the adjudicator without the chronology needed to evaluate the petition.

Use the correct filing and service record

DWC Guide 11 identifies the petition-to-reopen procedure and filing form. Complete the caption and case information accurately, state the grounds, attach or identify supporting evidence, and serve the parties. Keep the filed copy, EAMS confirmation or district-office receipt, and proof of service together.

Separate reopening from other benefit disputes

A treatment authorization dispute, petition for penalties, enforcement issue, or challenge to an existing calculation may require a different procedure. Filing one document does not automatically preserve every theory. Review the award and procedural posture before selecting the request and continue complying with other deadlines.
