Los Angeles Employee Misclassification: ABC Test, Wage Records, and Claims

A contract calling someone an independent contractor does not decide California employee status. The governing test can depend on the claim and statute, so the record should address the work relationship rather than labels alone.
Identify the governing claim and test
Separate wage-order and Labor Code claims from tax, unemployment, workers’ compensation, and other statutes. The ABC test and other standards do not necessarily apply identically in every setting.
Record the hiring entity, intermediaries, contract versions, entity names, and the period of work.
Document control and the business relationship
Preserve instructions, scheduling, supervision, discipline, pricing, customer ownership, tools, uniforms, branding, location, exclusivity, and the ability to accept or reject work.
Also document whether the worker operated an independently established business serving other clients in fact, not merely on paper.
Calculate wage consequences carefully
Organize hours, rates, pay records, expenses, deductions, meal and rest periods, overtime, final pay, and wage statements by pay period.
Avoid multiplying assumptions across a long period. A transparent spreadsheet should trace each amount to a source document.
