Humanitarian Detention: The Five-Tab Emergency Packet Counsel Can Audit Quickly document preparation

An emergency detention packet should be small enough to audit under time pressure and complete enough to expose the decisive gap. Five tabs usually reveal whether the problem concerns eligibility, agency protection, custody authority, procedure, or remedy.

The custody tab must identify whether the government invokes 8 U.S.C. § 1225(b), § 1226(a), or § 1231(a); those provisions authorize different procedures and remedies.

Tab 1: identity and representation

Include a verified identity sheet, A-number, aliases, family relationships relevant to derivative status, counsel notice, and safe contact plan. Keep addresses and survivor details out of copies that do not need them.

Tab 2: the operative USCIS action

Use the actual receipt, bona fide or prima facie notice, approval, waiting-list placement, deferred-action grant, or SIJS notice. Label principal and derivative records. Add a short table of dates and validity periods.

Tab 3: custody and removal authority

Collect the arrest record, warrant, I-213 when available, Notice to Appear, custody decision, bond history, final-order status, transfers, and scheduled removal information.

Tab 4: missing or defective process

Place revocation notices, stay requests, delivery confirmations, hearing requests, and agency responses together. Identify the specific process promised by statute, regulation, policy, or prior order.

Tab 5: remedy and logistics

State the requested action, legal vehicle, responsible official, release or return logistics, and status-report proposal. A remedy chart prevents a request for a bond hearing from being confused with restoration of deferred action or a statutory stay determination.
